المحكمة الدولية: تعيين باراغوانث رئيسًا للمحكمة بعد استقالة كاسيزي لأسباب صحية

عُيّن القاضي سير دايفيد باراغوانث بالإجماع رئيسًا للمحكمة وقاضيًا رئيسًا لغرفة الاستئناف، بعد اقتراح ترشيحه من قبل نائب الرئيس القاضي رالف الرياشي والقاضي أنطونيو كاسيزي.
وصدر بيان إعلامي عن المحكمة الخاصة بلبنان أن التعيين أتى اثر استقالة القاضي كاسيزي، أمس الأحد، من منصب رئيس المحكمة، لأسبابٍ صحية. إلا أن كاسيزي سيواصل عمله كقاضٍ في غرفة الاستئناف بالمحكمة.
وأعلن باراغوانث: "إنه لشرف عظيم لي أن أحلّ في منصب رجل القانون المرموق، القاضي أنطونيو كاسيزي. وإننا محظوظون بأن نواصل الاسترشاد بحكمته وخبرته في عملنا".
وللقاضي باراغوانث خبرة تناهز الخمسين عامًا في مجال القضاء. فقد عمل كمحامي دفاعٍ وادعاء. وهو يتمتع بخبرة راسخة تميّزت بتولّيه منصب قاض في المحكمة العليا وفي محكمة الاستئناف في نيوزيلندا، وبترؤسه لجنة القانون في نيوزيلندا.
وأضاف باراغوانث "يقتضي اكتساب ثقة الشعب بالمحكمة الالتزام الصارم بسيادة القانون. ومن حق الشعب اللبناني أن تطبّق المحكمة أرفع معايير العدالة من دون خوف أو معروف، ومن دون انحياز أو سوء نية".
وتابع قائلاً: "تتمثّل الركيزة الأساسية للمحكمة في قرينة البراءة المُكرّسة في قاعدتين توأمين تقضيان بوقوع عبء الإثبات على عاتق المدعي العام، وبوجوب كون أدلّة الادعاء مقنعة بدون أدنى شكٍ معقول. وأودّ التأكيد للشعب اللبناني برمّته بأننا نعتبر أنفسنا قضاته".
وقد أعرب القاضي كاسيزي عن صعوبة اتخاذ قرار تنحّيه من منصب رئيس المحكمة على الصعيد الشخصي، إلا أن هذا القرار كان القرار الصائب الذي يصبّ في مصلحة المحكمة.
مضيفاً: "لقد حاولت لسنتين ونصف أن أقود المحكمة بصورة فعالة وعادلة في ظل ظروف صعبة".
وتابع قائلاً: "بما أنه يصعب عليّ الآن الوفاء بالمهام الإدارية والواجبات الخارجية المنوطة بالرئيس، لا أشعر بأنني قادر على تأمين القيادة التي تستلزمها المحكمة والتي تستحقّها. إلا أنني سأواصل مهامي كقاضٍ في غرفة الاستئناف وسأعمل جاهدًا على المسائل القضائية المرفوعة أمامها".
ويضطلع رئيس المحكمة بمسؤولياتٍ واسعة النطاق، تتضمن الإشراف على سير عمل المحكمة بفعالية وحسن سير العدالة، وكذلك تمثيل المحكمة في علاقاتها مع الدول، والأمم المتحدة، والهيئات الأخرى.
وختم كاسيزي قائلاً: "أنا على يقين من أن الرئيس الجديد، وهو قاضٍ مرموق، سيرشد المحكمة خير الإرشاد الآن وقد بدأت الإجراءات القضائية وأصبحت الغرف تعمل على أكمل وجه. ولي ملء الثقة بأن القاضي باراغوانث سيضمن حسن سير عمل المحكمة بأقصى درجات الفعالية والسرعة والعدالة".

Cassese an outstanding Judge indeed that never compromised on Justice or was ever intimidated or manipulated, I'm sure Mr. Baragwanath will carry the Baton all the way to the end, when the Lebanese will finally see some closure when it comes to uncovering the Iranian/Syrian regime murderers behind a long string of murders that have plagued Lebanon and has prevented its rise for such a long time as a Beacon of hope tolerance and diversity, and economically vibrant and modern society, a message of hope for all the oppressed peoples in the Middle East that only want Peace and a better future for their children.
