قرر المجلس الدستوري رد الطعن المقدم من قبل "التيار الوطني الحر" بشأن التمديد الذي أقره لنفسه مجلس النواب مطلع الشهر الجاري، لتفادي تمدد الفراغ الى المؤسسات الدستوري.
واثر اجتماع عقده المجلس، قبل ظهر الجمعة، اعلن عن قرار بالاجماع بـ"القبول المراجعة شكلاً ورد الطعن للحيلولة دون التمديد بالفراغ في المؤسسات الدستورية".
كما قرر المجلس نشر القرار في الجريدة الرسمية.
وأكد ان "دورية الانتخابات مبدأ دستوري لا يجوز المس به مطلقا"، فضلاً عن "ربط اجراء الانتخابات النيابية بالاتفاق على قانون انتخاب جديد او اي ظرف آخر عمل مخالف للدستور".
ولفت الى ان "التدابير الاستثنائية ينبغي ان تقتصر على المدة التي يوجد فيها ظروف استثنائية فقط"، مضيفاً، وجوب "اجراء الانتخابات النيابية فور انتهاء الظروف الاستثنائية وعدم انتظار انتهاء الولاية الممدة"
واعتبر المجلس ان "تعطيل المؤسسات الدستورية وعلى رأسها رئاسة الجمهورية انتهاك فاضح للدستور".
ونُقل عن زوار رئيس "التيار الوطني الحر" النائب ميشال عون قوله ان "قرار المجلس الدستوري خاطئ وحجة فراغ المؤسسات غير مبررة".
يُذكر ان مجلس النواب أقر في 5 الجاري، تمديد ولايته للمرة الثانية على التوالي حتى 20 حزيران من العام 2017، وسط تصويت نائبي "الطاشناق" ضد التمديد وفي ظل مقاطعة نواب "الكتائب" و"التيار الوطني الحر"، الذين تقدموا بطعن بالتمديد أمام المجلس الدستوري.
وفي 31 ايار 2013 أقر البرلمان تمديد ولايته للمرة الاولى انتهت في 20 تشرين الثاني 2014 في جلسة حضرها 97 نائبا، صوتوا جميعهم للتمديد، وقاطعها نواب "التيار الوطني الحر"، بعد أن فشلت جميع الأطراف السياسية بالوصول إلى قانون انتخاب في أربع سنوات منصرمة.
ويعيش لبنان فراغاً رئاسياً منذ ايار الفائت، بعد رفض رئيس الجمهورية السابق ميشال سليمان تمديد ولايته، وفشل النواب في انتخاب رئيس جديد، الامر الذي انعكس على مجلس النواب الذي اقر تمديد ولايته مطلع الجاري، بسبب رفض بعض الافرقاء اجراء الانتخابات النيابية في ظل الفراغ، وتخوّف البعض من الاوضاع الامنية.

You see aoun knows everything and better than everybody. He is a general, a warrior, a politician, and a seasoned judicial authority on constitutional matters.

Accounts, do you know this joke? When Aoun died,he arrived to the gates of heaven to be judged by Saint Peter, the keeper of heaven's gates. So Saint Peter asked Aoun, tell me your story son. But Aoun instead replied by asking Saint Peter about what he was doing on that seat as Aoun feels the seat was his. Lol. The other joke is this: Saint Peter wanted to test whom of two lied more, Geagea or Aoun, so he asked them to walk over the water in a pool, the one who walked meant that he did not lie, the one who walked meant he was honest. So Geagea being the first to cross naturally sank way down. Then Aoun's turn, Lo, he walked on the water all the way. Suspicious Saint Peter sent a diver to check, and this is what he saw, Sayed Hassan carrying Aoun on his shoulder walking under water. Lols.

"The staging of the Parliamentary elections on a regular basis is a constitutional principal that should never be tampered with". "The council remarked that the extension violates the constitution". Can someone tell me please ' is the council legislating or is it supposed to be interpreting the law? If they are legislating then they probably arrived at the right decision according to their believes, if they are interpreting the law then they are contradicting themselves and should have accepted the appeal against the extension.
