الراعي يرى أن المتهم بريئاً حتى تثبت إدانته: لا يحق لأي طرف أن يطالب بتسليم المتهمين باغتيال الحريري

أكد البطريرك الماروني مار بشارة بطرس الراعي في مؤتمر صحافي عقده مساء الخميس في الفاتيكان أنه"لا يحق لاي طرف ان يطالب بتسليم المتهمين لان المتهم يبقى بريئا حتى تثبت ادانته"، وذلك رداً على سؤال مطالبة قوى 14 آذار بتسليم المتهمين باغتيال الرئيس الشهيد رفيق الحريري.

وبناء على استفسار وجهه موقع Naharnet الإلكتروني بالنسبة لموقف البطريرك الراعي، أرسل المسؤول الاعلامي في الصرح البطريركي وليد غياض ايضاحاً للموقع عينه، وهو التالي:

"لقد ميّز سيدنا بين الاتهام السياسي وبين القضاء، معتبراً ان من يطالب يجب ان يكون القضاء، منعاً لتعقيد الامور

واكد انه مع تسليم المتهمين في حال طلبتهم المحكمة لانه ليس كل متهم مذنبا وانه لا يمكننا اعتباره مذنب قبل صدور حكم المحكمة النهائي واستنفاد كل درجات المحاكمة".

يذكر أنه بحسب القرار الاتهامي الصادر عن المحكمة الدولية الخاصة بلبنان، فان اربعة عناصر من حزب الله ضالعون في اغتيال رئيس الحكومة رفيق الحريري (في 14 شباط 2005) وصادرة بحقهم مذكرات توقيف من المحكمة الخاصة بلبنان تم تسليمها في 30 حزيران 2011 الى السلطات اللبنانية اضافة الى نشرات حمراء صادرة عن الانتربول.

وكانت المحكمة اشارت في 23 تشرين الثاني الى انها تنتظر معلومات من جانب السلطات اللبنانية بشأن التدابير المتخذة لتوقيف المتهمين اضافة الى تقرير من مكتب المدعي العام قبل اتخاذ قرار.

يذكر أنه قررت المحكمة الدولية الخاصة بلبنان محاكمة المتهمين الأربعة غيابيا في قضية اغتيال رئيس الوزراء الأسبق رفيق الحريري و22 آخرين غيابيا، وذلك بعد أن كانت عقدت اجتماعات علنية في مقرها لمناقشة هذا الأمر.

الى ذلك، كانت الوكالة الوطنية للإعلام قد لفتت الى أن "الراعي أكد في مؤتمر صحافي مساء الخميس في المدرسة المارونية في الفاتيكان "ان لبنان يجب ان يكون عنصر استقرار في محيطه العربي وهذا الاستقرار لا يبنى الا بالتفاهم والحوار مع بعضنا البعض" مشددا على "ضرورة تلبية دعوة رئيس الجمهورية ميشال سليمان الى طاولة الحوار والعمل على تغيير الحكومة اذا لزم الامر ولكن من خلال عبور هادئ لا يوقعنا بالفراغات".

وأضافت أن "الراعي لخص مفاهيم الاحتفال بعيد الاستقلال بثلاث ثوابت أساسية وهي " المحافظة على سيادة القرار في الشؤون الداخلية والخارجية، سلامة الارض المعترف بها دوليا بحيث لا يوجد عليها سلاح او جيش اجنبي واي سلاح او تنظيم عسكري غير شرعي، والكرامة الوطنية".

كذلك، شدد الراعي على "ضرورة اجراء الانتخابات النيابية في موعدها مسجلا اعتراضه على اعتماد قانون الستين"، مستدركاً أنه " يجب احترام المواعيد الدستورية، ولكن لن نقوم باقفال طريق او احراق اطارات اذا تم اعتماد قانون الستين".

you know what is funny guys? what is funny is that it is OK for the army intelligence to apprehend hashash in Batroun, beating him up for hours, and that is because he issued comments against the standstill the army caused the other day!

We just need the cardinal to tell us when Xmas is, the grand mufti when Ramadan starts, the grand rabi when Hanukkah starts and that's pretty much it. Let the democratically elected people manage policies and the judicial system ask the 4 Hezbollah to be in jail till the get judged. Will get released and compensated if proven innocent. A very disappointing statement from Patriarch Rahi especially when everybody knows that suspects need to be interrogated by the authorities in order for the investigation to move forward, and thus their innocence or guilt has nothing to do with the fact that authorities have to questions them.

To his Excellency, please "Say it ain't so." Tell us this is a misquote. The Special Tribunal for Lebanon is not a "competent" legal authority?
You and/or your advisors have either been struck with madness or you have received a threat against the all christian people in Lebanon. Surely nothing else could have led to such a rash statement.

Again, Patriarch has misspoken. The taking into custody of suspects upon reasonable cause is a time honored method of criminal procedure. In fact, the very act of a custodial arrest upon probably cause has been a part of jurisprudence going back centuries. Arrest does not equal conviction, probably cause, does not mean guilt beyond a reasonable doubt. And there is always the right of bail in the event that the suspect is not a flight risk.
Patriarch is many things, but a criminal prosecutor, he is not and so he should not be weighing in on such things. Especially where there are legal as well as political considerations. Patriarch is neither lawyer nor politician.

The involvement of HA in this murder is beyond doubt, the question is how much will it cost to bring them to trail.
Is this the real fear?
Should we allow them to roam free and continue their killing spree?
Which direction will cost more?
Had there been just the killing of Harriri, maybe we can ask these questions, but the continuous slaughter of opposing political figures and innocent bystanders leaves us only one choice.
