سياسيون لبنانيون ينتقدون حكم المحكمة العسكرية بحق ميشال سماحة

يشن سياسيون لبنانيون بينهم وزراء ونواب حملة عنيفة على المحكمة العسكرية التي اصدرت حكما بالسجن لمدة اربع سنوات ونصف السنة على الوزير السابق ميشال سماحة لادانته في قضية نقل متفجرات من سوريا لتنفيذ عمليات تفجير واغتيالات.
ففي تغريدة على صفحته على موقع التواصل الاجتماعي "تويتر"، الخميس، قبل ظهر الخميس، اعتبر رئيس "الحزب التقدمي الاشتراكي" النائب جنبلاط ان "حكم المحكمة العسكرية في قضية ميشال سماحة يشرع الاغتيال والتفجير".
وفي تصريح له، رأى جنبلاط انه "لا يمكن وصف حكم المحكمة العسكرية بأقل من فضيحة قضائية وعسكرية وسياسية"، مضيفاً انها "تتنكر للقانون وتطبيق حكم العدالة لمن خطط وشارف على تنفيذ جرائم وتفجيرات إرهابية كانت ستودي بحياة المئات من الأبرياء وتشعل الوضع الداخلي أمنياً وسياسياً".
وتابع ان "هذا الحكم المخفف والملطف الذي يناقض كل الإعتبارات السياسية والقانونية إنما يفتح الباب أمام ملف القضاء العسكري الذي بات يستوجب نقاشاً وإعادة تصويب لا سيما بعد أن توسعت صلاحياته أفقياً وعامودياً بما يتخطى إختصاصه الأساسي أي تعاطي".
بدوره، رأى رئيس "حزب القوات اللبنانية" سمير جعجع عبر "تويتر" انه: "حان الوقت للتخلُص من المحاكم الاستثنائية وبطليعتها العسكرية والعودة الى المحاكم المدنية".
وتساءل قائلاً: "ان حكم المحكمة العسكرية في قضية سماحة يُقوّض ثقة اللبناني بدولته وبوجود عدالة على هذه الأرض، فهل هذا هو المطلوب؟"، وأيّدموقف وزير العدل اشرف ريفي وغرّد عبر تويتر قائلاً: "كلّنا مع ريفي في ردة فعله".
وكان ريفي (التابع لتيار المستقبل) قد نعى الاربعاء المحكمة العسكرية مطالباً بالطعن بالحكم وبالغاء المحكمة، لأننا "لن نكون شهود زور على استباحة الأمن اللبناني".
وفي تصريح لريفي من أمام ضريح رئيس الحكومة السابق رفيق الحريري في وسط بيروت، قال: "مستمرون في نضالنا نحو اقامة الدولة في وجه الدويلة"، لافتاً الى ان "مشروعي أصبح في لمساته الاخيرة بتعديل قانون المحكمة العسكرية".
ومن المكان عينه، أعلن وزير الداخلية نهاد المشنوق (التابع لتيار المستقبل): "سنعمل على ألا يتكرر ما حدث ولكي لا يحاكم اللبنانيون بقضايا وبميزان غير موحّد".
وحكمت المحكمة العسكرية الدائمة الاربعاء على سماحة الذي كان حتى لحظة توقيفه مستشارا للرئيس السوري بشار الاسد، بالسجن لمدة اربع سنوات ونصف السنة وتجريده من حقوقه المدنية، بعد ادانته بـ"محاولة القيام باعمال ارهابية والانتماء الى مجموعة مسلحة". وفور صدور الحكم، تتالت ردود الفعل الشاجبة لا سيما من الفريق المناهض لسوريا وحليفها حزب الله.
وكان سماحة اعترف في جلسة محاكمة في 20 نيسان/ابريل، بأنه نقل متفجرات من سوريا لتنفيذ سلسلة تفجيرات واغتيالات في لبنان. وقال انه تسلم "مبلغ 170 ألف دولار من السوريين" ووضعها في صندوق سيارته مع المتفجرات، ثم سلم الاموال والمتفجرات الى احد معارفه ويدعى ميلاد كفوري في مرآب منزله في بيروت.
ودافع سماحة عن نفسه بانه وقع "في فخ" نصبه له الشاهد "المحرض" كفوري الذي ابلغ القوى الامنية اللبنانية عن مخطط سماحة الذي تم، بحسب القرار الاتهامي، بالتنسيق مع مدير مكتب الامن الوطني في سوريا اللواء علي مملوك.
واصدر القضاء اللبناني مذكرة توقيف في حق مملوك واحد معاونيه.4

Why does the military allow itself to be dented from time to time? Has it not been warned time and time that meddling into its decision mechanism will simply damage its integrity? How hard is the army trying regain its integrity with the people? If the MT cannot dispense fair justice, then let it take the rest it deserves and leave the civil courts to run the business of justice, simple and end of story.

I agree with you Exfpm, I know well that court, they infiltrated it years back during the Syrian occupation, remnants of the Syrian sawdust still impede the proper running of justice there, but all in due time. One by one, they'll go, just like when wind blows sawdust away.

Mystic - do you know the difference between plurality and majority? Majority is 50 percent plus one. Plurality is the largest among several group but not necessarily a majority.

If Lebanon had a legal system, it would have long since freed itself from organizations like the PLO and Hezbollah. There is no majority in Lebanon but a recollection of minorities who will in the event unite and turn against an oppressor. Right now the oppressor is called Hezbollah and because of that dumb mentality, the Shiites will one be unwelcome in their own land.
